US Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. After his repatriation to the United States to face human smuggling allegations, he was detained in federal detention.
In her order, the court noted that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
Background of the Case
The legal challenge center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in Tennessee.
Conditions of Release
The court, who was overseeing his petition to removal in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.
This decision marks a notable turn in a complex immigration battle featuring allegations of mistaken imprisonment and contested gang affiliations.
